2. Service Description
Bhomu provides an AI-powered platform for generating professional model images for clothing items including sarees, lehengas, and dresses. Our Service includes:
- Upload and processing of clothing item images
- AI-powered model image generation
- Gallery management and storage
- Wallet-based payment system for image generation
- User account and profile management
3. User Accounts
3.1 Registration: You must register for an account to use the Service. You agree to provide accurate, current, and complete information during registration.
3.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
3.3 Account Termination: We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activities.
4. Pricing and Payment
4.1 Wallet System: Our Service operates on a prepaid wallet system. You must add INR credits to your wallet before generating images.
4.2 Generation Costs: Each AI-generated model image costs ₹10-₹20 INR, which will be deducted from your wallet balance after successful image generation.
4.3 Failed Generations: If image generation fails, INR will not be deducted from your wallet. All failures are logged for manual admin review, and no automatic refunds are issued.
4.4 Non-Refundable: Wallet credits are non-refundable except as required by applicable law or at our sole discretion.
4.5 Price Changes: We reserve the right to modify pricing with 30 days' prior notice to users.
5. Intellectual Property Rights
5.1 Your Content: You retain all ownership rights to the original images you upload. By uploading content, you grant us a license to process, store, and generate model images from your uploads.
5.2 Generated Images: Generated model images are your property. You may use them for any lawful commercial or personal purpose.
5.3 Our Platform: All platform features, design, code, and AI models remain our exclusive property and are protected by intellectual property laws.
6. Acceptable Use Policy
You agree not to use the Service to:
- Upload illegal, harmful, or offensive content
- Violate any applicable laws or regulations
- Infringe on intellectual property rights of others
- Upload images containing nudity or explicit content
- Attempt to reverse-engineer or manipulate our AI systems
- Use automated scripts or bots to access the Service
- Resell or redistribute our Service without authorization
7. Disclaimers
7.1 Service Availability: The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free service.
7.2 AI-Generated Content: AI-generated images may have imperfections. We do not guarantee perfect accuracy in all generated images.
7.3 Third-Party Services: We use third-party services (AWS S3, Firebase, etc.) and are not liable for their failures or security breaches.
8. Limitation of Liability
To the maximum extent permitted by law, Bhomu shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.
9. Data Retention
We retain uploaded images and generated model images for the duration of your account. You may delete images from your gallery at any time. Upon account deletion, we will remove your data within 30 days.
10. Dispute Resolution
Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with Indian law, and the courts of India shall have exclusive jurisdiction.
11. Modifications
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the modified Terms.
